1. Agreement to Terms
By accessing or using the website located at pneumamethod.com (the "Website"), enrolling in any program offered by Ballenger Practitioner Academy LLC ("Company," "we," "us," or "our"), or purchasing any product or service from us, you ("Participant," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Website or enroll in our programs.
2. About Ballenger Practitioner Academy LLC
Ballenger Practitioner Academy LLC is an Iowa limited liability company offering practitioner education, clinical training, and certification programs through The Pneuma Method™ Basic Certification and related programs. 3. Educational Nature of Our Programs
3.1 Educational Purpose Only
All programs, certifications, courses, seminars, and materials offered by Ballenger Practitioner Academy LLC are provided for educational and informational purposes only. Completion of any program, including The Pneuma Method™ Basic Certification, does not:
• Confer a medical license or any state-issued professional license
• Authorize the practice of medicine, chiropractic, nursing, or any other licensed profession
• Expand your existing scope of practice beyond what is authorized by your current license and state regulations
• Constitute medical advice, diagnosis, or treatment recommendations
3.2 Practitioner Responsibility
You are solely responsible for ensuring that your use of any techniques, methods, or information learned through our programs complies with:
• The scope of practice defined by your individual professional license
• The laws and regulations of your state, province, or country of practice
• The ethical guidelines of your professional licensing board or certifying organization
Ballenger Practitioner Academy LLC is not responsible for any disciplinary action, legal liability, or professional consequences arising from your application of program content in your practice.
4. Enrollment and Registration
4.1 Eligibility
Our programs are open to licensed healthcare practitioners and certified health and wellness practitioners. Enrollment does not require a state professional license, but participants are responsible for ensuring compliance with their applicable scope of practice as described in Section 3.2 above.
4.2 Enrollment Confirmation
Enrollment in a program is confirmed upon receipt of full payment or an approved payment arrangement. We reserve the right to refuse enrollment at our discretion.
4.3 Accurate Information
You agree to provide accurate, complete, and current information when enrolling. Providing false or misleading information may result in immediate termination of enrollment without refund.
5. Pricing and Payment
5.1 Pricing
All prices are listed in U.S. dollars. Prices are subject to change for future program cohorts. The price applicable to your enrollment is the price in effect at the time your payment is received and confirmed.
5.2 Early Bird Pricing
Early bird pricing, where offered, is available only for the specified promotional period. Early bird rates apply only to enrollments completed and paid in full before the stated deadline. We reserve the right to modify or discontinue promotional pricing at any time.
5.3 Required Materials
Certain programs require the purchase of supplemental materials, including the Pneuma Method Clinical Kit. These materials are priced separately from tuition and are described at the time of enrollment. Required materials must be purchased to complete certification.
5.4 Payment Processing
Payments are processed through third-party payment processors. By submitting payment, you agree to the terms of the applicable payment processor. We do not store credit card information on our servers.
6. Cancellation and Refund Policy
6.1 Tuition
All enrollment fees are handled on a case-by-case basis. If you need to cancel or modify your enrollment, please contact us directly at DrAlexBallenger@gmail.com as soon as possible. We will work with you in good faith to find a reasonable resolution, which may include transferring your enrollment to a future program cohort.
6.2 Required Materials
The Pneuma Method Clinical Kit and any other required physical materials are non-refundable once ordered, as they are prepared specifically for each participant.
6.3 Program Cancellation by Company
In the unlikely event that we cancel a scheduled program, enrolled participants will receive a full refund of tuition paid or the option to transfer to a future cohort. We are not responsible for travel, accommodation, or other expenses incurred by participants in connection with a cancelled program.
7. Program Content and Intellectual Property
7.1 Ownership
All program content, including but not limited to course materials, videos, written guides, the Pneuma Method™ protocol, clinical reference charts, prayer materials, the Ballenger Practitioner Academy name and logo, and all other materials provided in connection with our programs, are the exclusive intellectual property of Ballenger Practitioner Academy LLC and are protected by applicable copyright, trademark, and intellectual property laws.
7.2 License to Participants
Upon enrollment and completion of payment, participants receive a limited, non-exclusive, non-transferable license to use program materials for their own personal clinical practice. This license does not permit:
• Reproduction, distribution, or sharing of materials with any third party
• Use of materials in any commercial training, course, or educational program
• Modification, adaptation, or creation of derivative works based on program materials
• Recording of live seminar sessions without prior written consent
7.3 Certification
The Pneuma Method™ Basic Certification designation may be used by certified practitioners to identify their training. Certified practitioners may not represent themselves as trainers, instructors, or certifying authorities for the Pneuma Method without express written authorization from Ballenger Practitioner Academy LLC.
8. Disclaimer of Warranties
THE PROGRAMS, WEBSITE, AND ALL CONTENT PROVIDED BY BALLENGER PRACTITIONER ACADEMY LLC ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE MAKE NO WARRANTY THAT OUR PROGRAMS WILL MEET YOUR SPECIFIC CLINICAL OR BUSINESS OBJECTIVES, THAT PROGRAM CONTENT IS COMPLETE OR ERROR-FREE, OR THAT THE TECHNIQUES TAUGHT WILL PRODUCE ANY PARTICULAR CLINICAL OUTCOME FOR YOUR PATIENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BALLENGER PRACTITIONER ACADEMY LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR ENROLLMENT IN OR USE OF OUR PROGRAMS, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM YOUR APPLICATION OF PROGRAM CONTENT IN YOUR CLINICAL PRACTICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR PROGRAMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC PROGRAM GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Ballenger Practitioner Academy LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of program content in your clinical practice; (b) your violation of these Terms; or (c) your violation of any applicable law or regulation.
11. Community and Ongoing Membership
Access to any practitioner community, membership platform, or ongoing support offered by Ballenger Practitioner Academy LLC is subject to additional terms communicated at the time of enrollment or at the live seminar. Membership fees, if applicable, are recurring and will be disclosed clearly before any commitment is made. We reserve the right to modify, suspend, or discontinue community access at any time with reasonable notice to members.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or our programs shall be resolved first through good faith negotiation between the parties. If negotiation is unsuccessful, disputes shall be submitted to binding arbitration in Des Moines, Iowa under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for protection of intellectual property.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our Website. Your continued use of the Website or enrollment in programs after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify enrolled participants of material changes by email.
